By activating or otherwise using UTEP FanZone, you are agreeing to the following terms and conditions (these “Terms and Conditions”). You understand that Augeo Affinity Marketing, Inc., and its subsidiaries and vendors and partners (collectively, “Augeo”) make available online information and services to fans of this program (“Fans”). By activating or otherwise using UTEP FanZone, you are indicating that you are 18 years old or older and agree to be bound by this Agreement. You acknowledge that these Terms and Conditions may be modified at any time. Any changes will appear on this page. It is your responsibility to refer to these Terms and Conditions prior to using UTEP FanZone. You will be deemed to have accepted any change to these Terms and Conditions if you register, use or continue to use UTEP FanZone after that change has been posted here.

UTEP FanZone is a program that provides Fans with savings, benefits and opportunities to earn and redeem points and win prizes, offered by participating merchant locations in the United States and online.

1. Eligibility
Fans must be U.S. Residents and at least 18 years of age to participate.

2. Registering for UTEP FanZone
In order to access the online benefits and features you must create an account and register on www.utepfanzone.com. When you create an account or register at UTEP FanZone, you must provide accurate and complete information (including but not limited to username, email; and password) and advise of any changes by updating your online profile or contacting UTEP FanZone Customer Service. UTEP FanZone will use this information to create your account and provide you with program information, specials, features, discounts, etc.

Those who complete the registration form are responsible for submitting correct personal information during the time of registration. Any future changes required by a fan must be submitted by the fan via his or her account. Any change made by a registered Fan is the sole responsibility of the Fan.

When you register, you will be asked to create a password to view your account. You may not select a password that violates anyone’s rights or one that, in Augeo’s sole discretion, is considered offensive, improper or inappropriate. If you do so, Augeo may modify or delete it.

Augeo does not permit the sharing of your account, card number, password oroffers with any other person. If Augeo reasonably believes that any of your UTEP FanZone materials are being used in any of these ways, Augeo reserves the right to cancel your UTEP FanZone account immediately. If you believe someone has used any of your UTEP FanZone materials without your authorization, please contact UTEP FanZone Customer Service.

3. Using the UTEP FanZone Application & Mobile Application
Your UTEP FanZone account &mobile application provides you access to certain savings, benefits and services. To access the complete savings, benefits and services you must register with UTEP FanZone at www.UTEPFanZone.com. UTEP FanZone is nontransferable and may only be used by the person whose name is associated with the account.

Use of UTEP FanZone offers at a participating merchant’s location: You must present your UTEP FanZone mobile application or printed offer before you make a purchase at a participating merchant. A merchant has the right to deny an offer if you do not present your offer before payment.

Use of UTEP FanZone online: You can access the benefits of UTEP FanZone online by visiting www.UTEPFanZone.com and signing in. Featured offers, online shopping benefits and other benefits will require registration. Any visitor to UTEP FanZone is required to abide by the terms and conditions hereof.

Any use of the UTEP FanZone benefits and offers in a manner that violates the rules or regulations of any participating merchant or online partner is prohibited by this Agreement and is grounds for termination of your right to use UTEP FanZone, and will result in a forfeiture of any savings, benefits and services. Augeo reserves the right to cancel your account immediately in the event of such a violation.

4. Tracking Activity
Augeo uses various tracking technologies in conjunction with third party advertising affiliates. In most cases, the tracking used may require a cookie to be placed onto the Fan’s computer. This is required in order to fully track the Fan’s activity and to assure that the Fan is credited for any completed application for a specified product or service. Fans must have their browser enable cookies in order to partake in this program.

5. Expiration and Cancellation
Your UTEP FanZone account may be subject to expiration and cancellation at the discretion of Augeo following any breach of these Terms and Conditions by a Fan, termination of a sponsor, or termination of a particular program. A Fan will no longer be entitled to any offers, benefits or rewards following the expiration or cancellation of a UTEP FanZone account. Offers, benefits and rewards not redeemed by the date that aUTEP FanZone account is cancelled shall be forfeited.

6. The Web Site
The www.UTEPFanZone.com web site (the “Site”) offers the most up-to-date information on savings and partner benefits offered by participating merchants. Augeo is not responsible for participating merchant’s restrictions or changes to their offers. As a Fan, you will have to log in to access certain sections of the Site, using your username and password.

You can search for savings and participating merchants online. When you wish to purchase goods or services online at the Site or at a participating merchant’s web site, you may be required to enter a promo code in order to receive the discount. Some merchants and discounts may not be available in your community. Every effort has been made to make sure that all information is accurate within UTEP FanZone, but there is no guarantee and/or warranty to the accuracy of any information found within the Site. Participating merchants’ contact information has been provided for Fans. This information is believed to be accurate during the time of publishing, but Augeo will not be held liable for any inaccuracies. You should contact the participating merchant in advance to confirm it offers the discount. Even though Augeo makes efforts to keep the listing of participating merchants and savings up to date, Augeo is not responsible for incorrect or incomplete information regarding the participating merchants or their discounts. You may submit corrections for participating merchants or discounts in an email to info@utepfanzone.com.

The Site may be used to contact the UTEP FanZone Services department. For questions, concerns or suggestions e-mail info@utepfanzone.com. An agent will answer your e-mail by the next business day.

At any time, the Site may contain links to other web sites throughout the Internet; some or most of these links to such sites are operated and/or owned by third parties. Augeo may not be held liable for any inaccuracies of these links, availability of information, and/or the content of information that may be found within third party web site(s). During times of maintenance or other unforeseen occurrences, Augeo, the Site and/or merchants who participate in the discount program may be temporarily unavailable. Down times may vary and may be the result of various circumstances, many of which may not be the sole responsibility of Augeo. Nevertheless, during such circumstances, Augeo will actively work on resolving the problem, but cannot be held responsible for any inconveniences or loss of discounts, benefits or rewards of fans.

Augeo is not necessarily associated with the participating merchants or any other U.S. company or organization (private, public, or governmental) that may be listed throughout the Site, except for affiliate programs that advertise their products or services throughout Augeo, either through banner advertisements or direct text links.

Augeo makes no claim of any form of relationship or ownership to any of the logos or trademarks of any merchants listed throughout the Site.

No information or content found within the Site may be copied for commercial or noncommercial use without the prior written consent of Augeo.

You understand and agree that the use of the Site is for use at your own risk. No liability shall be held against Augeo for any interruption in service, or for any inaccuracies, or lack of reliability of which may be involved, nor does Augeo warrant against the results of such possible incidences that may cause damages and/or inconveniences to the Fan. Augeo will not be held liable for any possible consequential or any indirect damages that may be brought upon by the use, or inability to use the Site.

Augeo may suspend, change, or stop a service or any aspect of the Site at any time during operation, including but not limited to merchant information, databases or other content without any prior notification or liability, especially, but not solely, to comply with any local, state or federal laws, policies and regulations.

7. Discount Program
When making a purchase at a participating merchant, Fans must show their mobile phone or printed offer to calculate the discount, reward or other benefit they will receive. The participating merchant will immediately take the discount off of the purchase price at the point-of-sale. Periodically, promotions, incentives or other benefits associated with registering with UTEP FanZone may be offered. These promotions will be communicated on the Site and may be communicated directly to customers who have registered and agreed to receive program announcements. Fans may receive such communications through any of the contact information provided by them, including email, mail, fax, telephone, text, etc.

Augeo reserves the right to add, remove, and/or update any service provided within this discount program. Augeo may contact Fans about any additional services and/or adjustments to this discount program. However, Augeo has no obligation, under any circumstance, to contact Fans about changes made to the program.

8. Merchants, Discounts and Merchant Products
Augeo and UTEP FanZone merchants are independent contractors. Augeo is not responsible for the offers, rewards or bonus services offered by any merchant. Augeo is not responsible for the delivery of any offer, conduct of the merchant or changes by the merchant of its offer for any reason. Merchants may not discount all products offered for sale and stated discounts may vary at the point of purchase.

Augeo makes no warranty, expressed or implied, about any goods and services purchased from a merchant. Each Fan will look solely to the merchant for any and all discounts, returns, performance and nonperformance, warranty service and/or any damages suffered by a Fan or any third party arising out of the sale or use of goods or services provided by any merchant. If you have a dispute with a participating merchant, please report the dispute by contacting UTEP FanZone Customer Service for recording purposes. However, you must resolve the dispute directly with the participating merchant. Reports must be submitted and mailed in written form with the following information: merchant name, merchant address, date of purchase, discount denied and purchase information. AUGEO IS NOT LIABLE FOR ANY PRODUCTS OR SERVICES PROVIDED BY OR THROUGH ANY MERCHANT WHO PARTICIPATES IN THIS PROGRAM OR FOR ANY ERROR, OMMISSION OR INACCURACY IN ADVERTISING MATERIAL OR FOR ANY LIABILITY RESULTING DIRECTLY OR INDIRECTLY FROM A PRODUCT OR SERVICE PROVIDED BY ANY MERCHANT OR OTHER THIRD PARTY IN CONNECTION WITH THIS PROGRAM.

On the Site, Augeo provides links to selected merchants for your convenience only. Augeo is not responsible for the contents of any off-site pages referenced. Referencing off-site pages or any commercial product or service does not necessarily constitute or imply its endorsement or recommendation by Augeo. Neither Augeo nor any of its employees makes any warranty, express or implied, or assumes any legal liability or responsibility for the accuracy, completeness or usefulness of any information from links or documents available on the Site.

9. E-mail Policy and Communication Preferences
Fans have the option to receive UTEP FanZone communications and updates via e-mail, mobile phone, mail, telephone and/or fax when they register online. UTEP FanZone uses these updates to provide additional savings, special offers, site upgrades, new features, events, promotions and more. You have the option to e-mail us to opt out from receiving these e-mails using the link at the bottom of any promotional e-mail you may receive. You also have the option to email UTEP FanZone Customer Service to opt out of receiving the mobile phone messages. Fans can also update these preferences by logging into their account on www.UTEPFanZone.com.

Augeo reserves the right to e-mail you with information essential to your participation in this program (for example, information on lost passwords, UTEP FanZone shipment information and UTEP FanZone expiration/renewal). You will not have the option to opt-out of e-mails of this nature.

10. Changes to Offers or Merchants
Offers made available through UTEP FanZone may change from time to time. Augeo reserves the right in its sole discretion to change the offers and/or participating merchants at any time. In addition, merchants may elect to change offers from time to time. Augeo will make commercially reasonable efforts to make appropriate updates to the Site to reflect offer and/or merchant changes. For a listing of current offers, Fans should visit www.UTEPFanZone.com. If you become aware of a discontinued offer listed that is no longer valid or no longer being honored by a participating merchant, please notify Augeo by sending an e-mail to info@utepfanzone.com or contacting UTEP FanZone Customer Service. Augeo undertakes no obligation to provide a replacement or substitute offer for any offer discontinued.

11. Disclosures
UTEP FanZone may be receiving commissions and/or fees from sale of advertising and financial/insurance and/or other products and services from this program. Merchants and others may be provided courtesy copies of program information from this program.

12. Privacy
By using UTEP FanZone you acknowledge that any information we receive from or about you through UTEP FanZone will be treated according to our privacy policy.

The UTEP FanZone website is dedicated to respecting and defending your personal privacy. Our privacy policy and the control you have regarding the information you give us are explained below.

Information Collected
Whenever you visit the UTEP FanZone website, even if you have not registered with us, our web server logs and records mechanically-received and anonymous information from your web browser, including: your IP address; the UTEP FanZone page(s) you request; and any search terms you query.

UTEP FanZone uses this anonymous information to modify your familiarity on our site, to improve our services, and to show you more important advertising messages.

If you are registered with UTEP FanZone, your personal registration information is also recorded alongside the anonymous information in our web server log.  Once you register as a UTEP FanZone member, you are no longer anonymous to us. UTEP FanZone uses personal identification information for three main purposes:

• To fulfill your requests for certain services.
• To personalize the advertising and content you see on our pages.
• To tell you about special offers, including new products and services.

UTEP FanZone will not share personal information with other companies, organizations, or individuals unless:

• We have your consent to share the information.
• We need to share your information with our partner companies in order to provide a product or service you have requested.

UTEP FanZone will not sell or disclose your personally identifiable information to anyone, except as noted above.

UTEP FanZone operates secure data networks sheltered by industry standard firewall and password protection. We have security measures in place to attempt to protect against the loss, misuse or change of your user data. Only certain employees have access to the information you provide us. They have access only for customer care, analysis, and software maintenance.

Photo Contests:

• Photo contests will run throughout the school year. There will be a posting on UTEP FanZone announcing each new contest.
• Contest period will be defined for each individual contest and stated on the UTEP FanZone website.
• The contest will have a theme and fans will submit via an upload feature directly through FanZone, photos to support that theme.
• At the end of the contest period, a winner will be determined by the majority of votes.
• A prize will be awarded to the winner of the contest and the winner will be posted on the UTEP FanZone website along with the winning prize.
• No Pete Points will be awarded for winning a contest, but points can be earned during actions required as a part of participating.
• Winners will be notified by email and through the UTEP social sites what their prize is and how to receive their prize. You will have up to two weeks to pick up your prize.
• Participants may submit more than photo.
• UTEP FanZone, through their administrators and employees, reserve the right to delete, erase, remove, withdraw, omit, cancel or exclude any photo they deem, at their sole discretion, is inappropriate, improper or unsuitable for the contest or program for any reason whatsoever.

Pete’s Picks
Every game (home and away) will be loaded in the Pete’s Picks platform for the following sports at UTEP:

• Football
• Men’s Basketball
• Women’s Basketball
• Soccer
• Softball

Each fan that guesses the correct score of any game with the UTEP platform will win Pete Points. Points will be awarded on the following rules:

• 1st to guess the correct score of the game = 150 points plus a prize
• 2-25 to guess the correct score of the game = 75 points
• 26-50 to guess the correct score of the game = 50 points
• 50+ to guess the correct score of the game = 25 points

You can change your guess up until the very end of the game, as stated above, points decrease the later you guess the score.

Winners will be notified by email and through the UTEP social sites what their prize is and how to receive their prize. Winners will be posted on the UTEP FanZone website along with the winning prize. You will have two weeks to pick up your prize.

Texting Contest

• Texting contest will run throughout the school year at certain home games to support the Miners.
• A short code will be displayed at a home game on the big screen or scoreboard that notifies you when to text and what code to use.
• Everyone that sends the text will be entered in a drawing to win a prize. You do not have to be a member of UTEP FanZone to win the text contest, but if you are previously registered on the platform before responding to the text contest, you will be awarded 500 Pete Points in addition to being entered in the drawing (you must have provided your cell phone number in the registration process on UTEP FanZone in order to be awarded points for texting contests).

Winners will be notified by email and/or phone and through the UTEP social sites what their prize is and how to receive their prize. Winners will be posted on the UTEP FanZone website, along with the winning prize. You will have two weeks to pick up your prize.

Check In Contests

• Posters/signs will be posted at sport venues and some local merchants throughout the UTEP school year. These signs will contain a code to scan with your smart phone.
• There will be guidelines around which codes to scan and how often in each contest that is defined.
• To participate in any specific contest, you must be registered at UTEP FanZone and use the ‘scan’ function within that platform to scan the codes at merchant locations and/or sporting venues.
• Every fan that scans the codes will be awarded Pete Points and winners of specific contests will also win a prize. Winners will be posted on the UTEP FanZone website, along with the winning prize. You will have two weeks to pick up your prize.

General Contest and Program Rules:

No purchase is necessary to participate in the program or contests.

See exact contest rules for each contest in which you are participating. Participation in a contest constitutes full and unconditional acceptance of the contest rules, which may change from time to time to improve clarity and or comply with specific laws and/or regulations. Creating an account profile and participating in earning points constitutes acceptance and entry into the contest.

Eligibility: The program and contests are open to legal U.S. residents who have reached the age of 18 by date of entering into the program or contest. Employees of the school, and their respective affiliates, subsidiaries, advertising and promotion agencies and members of the immediate family or household of each are not eligible to participate in the contests. Program and contest participants considered recruited student-athletes or eligible for recruiting may not be eligible to win certain prizes due to NCAA policies.

In accordance with NCAA regulations, any student enrolled in the 9th through 12th grades or junior college is not eligible to participate in “experience” type prizes. Failure to comply places the entire university athletic department in violation of NCAA rules and jeopardizes the institution's good standing with the NCAA. By participating in the social experience/rewards program and/or contests, you confirm your knowledge of the NCAA rules and regulations pertaining to this request and agree to abide by all said rules, regulations and guidelines. Prize winners of any “experience” type contests, and any guests, are expected to dress and act in a professional and courteous manner while attending such experience or event. If at any time the prize winner or guest is not acting in a professional and courteous manner, the Athletics Department reserves the right to terminate the experience prematurely.

Registration may be completed on FanZone website by creating a user profile, valid e-mail address, connecting your social networking accounts and participate in social activities outlined in the FanZone program.

Entries submitted that are mechanically reproduced, forged, altered, or are ineligible, will be voided. Unless otherwise stated in the specific contest rules, only one entry, membership and/or account per person is allowed.

Selection of Winners: Winner will be selected according to each contest rule, see above for specific contest rules.

Winners that are randomly selected from entries or selected from top point earners, shall be done so using the most accurate information available to FanZone operators, however, FanZone shall not be liable, nor shall an entrant or member hold FanZone or FanZone’s operators liable, if it turns out the winner was chosen using inaccurate information. The selection of the winners will be made by FanZone operators, the companies or promotional organization whose decisions are final. Odds of becoming a winner depend on the number of valid entries received. The winners will be notified primarily by email, however, in certain circumstances, winners may be notified via a posting on a social network page or via telephone or text, where a winner may not necessarily be registered as a FanZone fan or participant. If the winner is unable (or unwilling) to claim their prize within the specified claim time frame, which is two (2) weeks from the date the prize winner is awarded unless otherwise stated in the contest, the prize may be placed back in the prize pool to be used in another contest.

Each contestant or member that is selected or determined a winner will be awarded the prize as part of the contest.

All prizes won will be awarded to the winner unless the winner does not claim the prize within the specified timeframe, which is two (2) weeks from the date the prize winner is awarded unless otherwise stated in the contest. Limit one prize per household. No substitutions or cash equivalents, except by sponsors for reason of unavailability in which a prize of equal or greater value will be awarded. Travel, taxes and other expenses are the responsibility of winners, except where noted.

FanZone reserves the right to substitute prizes of equal or greater value and/or to terminate, modify or withdraw any contest, in whole or in part including altering the manner in which the prizes are distributed at any time, without prior notice for any reason including, but not limited to, the delay or cancellation of any games or events.

Improper Conduct: If for any reason any contest is not capable of running as planned, including due to infection by computer virus, bugs, tampering, technical failure, human error or any other cause beyond the reasonable control of FanZone or any of its’ sponsors, that affects the administration, security, integrity, or proper conduct of the contest, the school and its promotional partners reserve the right, in their discretion, to disqualify any individual who tampers with the contest, require the return of any prize or its value, and to cancel, terminate, modify or suspend the contest, in which case, Winners will be determined at random from the entries received prior to cancellation, termination, modification or suspension. CAUTION: ANY ATTEMPT BY A PARTICIPANT OR OTHER PERSON TO DELIBERATELY DAMAGE THE WEBSITES OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTESTS MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE FANZONE AND ITS’ SPONSORS RESERVE THE RIGHT, IN THEIR SOLE DISCRETION, TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY'S FEES) FROM ANY SUCH PERSON TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.

Release of Liability: By participating in a FanZone promotion, contest or sweepstakes and/or accepting a prize, a participant/ winner agrees that the school and its affiliated companies and all of their respective parents, promotion agents, officers, directors, shareholders, employees, representatives and contractors (“Released Parties”) will have no liability whatsoever for, and will be held harmless by participant/winner for any liability for, injury, loss, or damages of any kind to persons (including death) and property (including damage to computers caused by bugs) due in whole or in part, directly or indirectly, from the acceptance, possession, use, or misuse of a prize or entry or participation in this promotion, or participation in any promotion, contest or prize related activity. Winners agree that FanZone operators, the school or involved sponsors may use their names or likenesses for advertising and publicity purposes without additional compensation (except where prohibited).

FanZone site, promotions, contest and/or sweepstakes may use third party connections and technology to account for points, activity, feeds and more. The company, affiliates, schools, athletic departments, promotion agents, officers, directors, shareholders, employees, representatives and contractors will be held harmless by participant/winner for a any liability, injury, loss or damage of any kind to the person and property that may result from these integrations including the loss, blockage or omission of points, activities, feeds and more that occur on the third party sites such as but not limited to Facebook, Twitter, Foursquare, Google+, Pinterest, YouTube, Instagram and others.

The school and its promotional partners reserve the right to require each winner to provide identification, to prove eligibility, and to return a signed and notarized Affidavit of Eligibility and Release of Liability Form (the "Eligibility Form") in order to claim a prize. The Eligibility Form certifies eligibility and compliance with these Official Rules and serves to release and to hold harmless the school and its affiliates, subsidiaries, advertisers, and agencies from and against any liability arising out of this giveaway. Failure to timely return the Eligibility Form will result in forfeiture of the prize. A prize notification returned as undeliverable will result in forfeiture of the prize. The prize winner is responsible for all applicable federal, state or local taxes. All prize winners and prizes may be reported to governmental tax authorities as required by law.

By entering the contest or sweepstake, and whether or not entrant wins a prize in the contest or sweepstake, each entrant grants to the Released Parties the right to the use of his or her name, likeness or photograph without compensation or further authorization in any publicity or for promotional purposes carried out by the Released Parties.

Redemption Catalog:

1. For a limited time, UTEP Fanzone is offering an opportunity for members to redeem a limited amount of their points for certain items.
2. The timing, items, point value, redemption limitations and all other redemption matters are at UTEP’s sole and complete discretion and may be changed in UTEP’s discretion at any time and for any reason.
3. Quantities of items available for redemption are limited. UTEP reserves the right to make an equal substitution should the need arise due to availability or other reason.
4. Items redeemed by member shall be non-refundable, non-exchangeable and should be handled and used at member’s own risk. Augeo & UTEP shall have no liability and member shall indemnify Augeo or UTEP against any and all claims related to the possession, handling and/or usage of such redeemed item.
